{"id":16641,"date":"2020-05-18T15:44:09","date_gmt":"2020-05-18T14:44:09","guid":{"rendered":"https:\/\/www.insuranceitaly.it\/?p=16641"},"modified":"2020-05-18T15:44:10","modified_gmt":"2020-05-18T14:44:10","slug":"seasonal-work-rules-for-entering-italy","status":"publish","type":"post","link":"https:\/\/www.insuranceitaly.it\/en\/news\/seasonal-work-rules-for-entering-italy\/","title":{"rendered":"Seasonal work: rules for entering Italy"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">&#8220;Seasonal work&#8221; means the <strong>employment relationship lasting between 20 days and 9 months<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The work activities that fall within the seasonal subordinate work quotas <strong>are exclusively the agricultural sector and the tourism-hotel sector<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The worker <strong>can enter<\/strong> Italy on the basis of a simple <strong>confirmation of hiring by the employer<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The issue of the <a href=\"https:\/\/www.insuranceitaly.it\/en\/news\/foreign-worker-heres-how-to-get-your-permit\/?lang=en\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"residence permit (apre in una nuova scheda)\">residence permit<\/a> for multi-year seasonal work does not exonerate the worker from requesting an entry visa annually to the Italian diplomatic or consular representation abroad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The employer, Italian or foreigner regularly residing, who wants to hire a seasonal employee, must submit a request for authorization to work at the <a href=\"https:\/\/www.interno.gov.it\/it\/temi\/immigrazione-e-asilo\/modalita-dingresso\/sportello-unico-limmigrazione\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Single Desk for Immigration (apre in una nuova scheda)\">Single Desk for Immigration<\/a> The submission of this request must take place within the quotas established by the <a rel=\"noreferrer noopener\" aria-label=\"Flows Decree (apre in una nuova scheda)\" href=\"https:\/\/www.interno.gov.it\/it\/notizie\/decreto-flussi-2019-ingresso-30850-lavoratori-non-comunitari\" target=\"_blank\">Flows Decree<\/a> and the time for release is 20 days, after which the employer will send the original clearance to the worker.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, the <strong>employer must demonstrate the availability of accommodation for the foreign worker<\/strong>: the rent cannot be excessive in relation to the quality of the accommodation itself and not higher than 1\/3 of the remuneration due to the worker.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The worker must present the authorization and passport, necessary to obtain an entry visa, to the Italian diplomatic mission of his country. <strong>Within 8 days of entering Italy, you must go to the Sportello Unico to sign the residence contract and <a href=\"https:\/\/www.insuranceitaly.it\/en\/news\/foreign-worker-heres-how-to-get-your-permit\/?lang=en\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"request a residence permit (apre in una nuova scheda)\">request a residence permit<\/a>.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The residence permit for seasonal work reasons<\/strong> allows you to carry out the activity for which the authorization has been issued and therefore does <strong>not allow you to carry out <a href=\"https:\/\/www.insuranceitaly.it\/en\/news\/foreign-worker-heres-how-to-get-your-permit\/?lang=en\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"independent or subordinate  (apre in una nuova scheda)\">independent or subordinate <\/a>activities<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The worker who has complied with the conditions of the residence permit<\/strong>, returning to his country upon expiry of the permit, <strong>has the right of precedence for seasonal work in the following year<\/strong>, compared to citizens of his own country who have never entered Italy for seasonal work .<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the foreign worker has worked as a seasonal worker in Italy at least once in the last 5 years, <strong>the employer can request the multi-year seasonal work permit from the <a href=\"https:\/\/www.interno.gov.it\/it\/temi\/immigrazione-e-asilo\/modalita-dingresso\/sportello-unico-limmigrazione\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Single Desk for Immigration (apre in una nuova scheda)\">Single Desk for Immigration<\/a><\/strong>, valid for a maximum period of 3 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The seasonal worker is one of the <strong>least protected categories <\/strong>and with <strong>inadequate guarantees<\/strong> for the type of <strong>arduous work <\/strong>that takes place.
